1. Agreement to Terms
By downloading, installing, or playing Nimbus: The Cloud Keeper ("the Game"), you agree to be bound by these Terms of Use and, if you got the Game from Apple's App Store, by the Apple Standard End User License Agreement (EULA). If you do not agree, do not download or use the Game.
2. License Grant
Mastalos Games grants you a limited, non-exclusive, non-transferable, revocable license to download and play the Game on devices that you own or control: on Apple-branded devices in accordance with the Usage Rules set forth in Apple's App Store Terms of Service, and on Android devices in accordance with the Google Play Terms of Service.
3. Intellectual Property Rights
All rights, title, and interest in and to Nimbus: The Cloud Keeper, including but not limited to artwork, characters, audio compositions, visual design, game mechanics, software code, and trademarks, belong exclusively to Mastalos Games. You may not decompile, reverse-engineer, modify, or distribute any part of the Game without prior written authorization.
4. In-App Content and Virtual Items
Drops, seeds, rainbows, buildings, cats and any other items or rewards in the Game are virtual. They have no real-world monetary value and cannot be redeemed, sold, or transferred outside of the Game.
5. Purchases
The Game offers optional purchases. Each one is made through the store you got the Game from: on iPhone and iPad through Apple's App Store, charged to your Apple Account; on Android through Google Play, charged to your Google Play account. That store handles the payment, under its own terms; how to ask for a refund is in section 6. What you buy is for use in the Game only, and section 4 applies to it.
- Consumable purchases. Rainbow packs: rainbows are an in-game currency, and you can buy packs as often as you like.
- A purchase for one season. The season pass (a non-renewing subscription, in the App Store's words): you can buy it once per season, and it is valid for the season that is running when you buy it, until that season ends (a season lasts 42 days). It does not renew by itself and does not carry over to the next season.
- Purchases made once. Remove Ads, which removes the ads between days (rewarded ads stay your choice); the Starter Pack; and two decor sets, the Japanese garden and the Winter village.
- A subscription that renews automatically. VIP, described in section 6.
"Restore purchases" is in the Game's Settings and at the bottom of the Shop. Use it after you reinstall the Game or change your device. It asks the store again what your account has bought, and brings back the purchases made once, the season pass of the season that is running, and an active VIP subscription, which also comes back by itself when you open the Game with the same Apple Account. On Android, what you bought for good comes back by itself when the Game starts on a phone signed in to the same Google account. Rainbow packs are not restored. A purchase stays with the store it was made in: it does not move between the App Store and Google Play.
6. VIP Subscription
The Game has one optional subscription that renews automatically.
- Name: VIP.
- Length: one month.
- Price: US$4.99 per month. The Game shows the price in your own currency before you buy.
- What it gives: no ads between days (rewarded ads stay your choice), one free emergency refill of the tank per calendar day, and 10% more drops from each day you play.
On the App Store (iPhone and iPad). Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically, one month at a time, unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged the monthly price for the renewal within 24 hours before the end of the current period.
You manage and cancel the subscription in your App Store account settings, under Subscriptions. "Manage subscription", on the VIP card in the Game's Shop, opens that page. A cancellation takes effect at the end of the period you have already paid for: VIP stays active until then and does not renew. Deleting the Game does not cancel the subscription.
A refund, for VIP as for any other purchase made on the App Store, is Apple's to grant, not ours. You ask for it at reportaproblem.apple.com.
On Google Play (Android). Payment is charged to your Google Play account when you confirm the purchase. The subscription renews automatically, one month at a time, and your Google Play account is charged the monthly price for each renewal, until you cancel. You can cancel at any time before the current period ends, and the cancellation applies from the next period on.
You manage and cancel the subscription in Google Play: in the Play Store app, tap your profile picture, then Payments and subscriptions, then Subscriptions, or open play.google.com/store/account/subscriptions. As on the App Store, a cancellation takes effect at the end of the period you have already paid for: VIP stays active until then and does not renew. Uninstalling the Game does not cancel the subscription.
A refund, for VIP as for any other purchase made on Google Play, is asked for through Google Play, under Google Play's refund policies.
These Terms of Use and the Privacy Policy apply to VIP as they do to the rest of the Game.
7. Advertising
The Game is free and shows ads provided by Google AdMob. What data the ads use, and the choices you have, are described in the Privacy Policy.
8. Updates and Service Changes
We continuously refine and improve the Game. Mastalos Games may release software updates, balance adjustments, or content expansions from time to time. We do not guarantee that the Game or any specific feature will remain available indefinitely.
9. Disclaimer of Warranties
The Game is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, Mastalos Games disclaims all warranties regarding uninterrupted service, fitness for a particular purpose, or error-free operation.
